Tech Mentor Urdu

Status: Draft for review — not ready for publication
Effective date: [Insert adoption date]

Editorial note — remove before publication: This draft reflects the confirmed ownership requirement, review-first complaint process, contact email, action against vendors for substantiated violations, and action against deliberate false reporting. Response deadlines, restoration procedures, review procedures, and the precise sanctions for complaint abuse remain unconfirmed. The statement about action against customers is interpreted as applying to knowingly false or abusive reports, not merely unsuccessful good-faith complaints. A vendor's failure to provide ownership evidence does not itself prove either infringement or dishonesty by the complainant. Confirm this interpretation and complete the marked details before publication. Obtain legal review for the jurisdictions served; this document does not establish eligibility for any statutory intermediary protection or certify a US DMCA process.

1. Purpose and Operator

Tech Mentor Urdu is a multi-vendor marketplace for digital downloadable products operated by Tech Mentor Urdu LTD, a company registered in the United Kingdom.

We do not allow vendors to sell copied products, unauthorised third-party products, or products that infringe copyright. This policy explains the marketplace's ownership requirements and the process for reporting and reviewing suspected infringement.

Company address:
2nd Floor College House

[Confirm the website domains covered by this policy and its relationship with the final Terms of Use and any separate Vendor Terms.]

2. Vendor Ownership Requirements

Vendors must own the products they offer and have the rights needed to sell and distribute them lawfully. Vendors must not copy another person's product, republish it as their own, or sell a third-party product they do not own.

Prohibited activities include:

  • Uploading or selling pirated or unauthorised copies;
  • Claiming authorship or ownership of someone else's work;
  • Repackaging copied products to disguise their origin;
  • Distributing protected code, designs, media, or other material without the necessary rights; and
  • Making false ownership statements or submitting fabricated evidence.

Changing a product's name, branding, appearance, or file structure does not by itself establish ownership or remove another person's rights.

Ownership of an original product does not automatically establish rights to every component used within it. Vendors are responsible for ensuring that incorporated third-party material is lawfully used and distributed and that applicable licence conditions are respected.

[Confirm any permitted arrangements for jointly owned products, authorised resale, or incorporated licensed components. Do not treat a licence to use a product as permission to resell that product.]

Vendor identity verification is separate from product ownership verification. Approval of an account is not a certification that every listing is original or lawful.

3. Customer Use of Purchased Products

A purchase does not automatically transfer copyright in the product. Permitted use depends on the licence disclosed and agreed at purchase, subject to applicable law.

Customers must respect the applicable licence and must not copy, redistribute, or resell protected material beyond the rights granted to them or otherwise permitted by law.

[Confirm actual product licence rules and align this section with the Terms of Use. No specific project limit, licence duration, or personal/commercial-use entitlement has been supplied.]

4. Who May Report a Concern

Copyright owners and people authorised to act on their behalf may submit a complaint. Customers and other visitors may also report suspected copying or infringement, but should clearly distinguish personal observations from a claim that they own the affected rights.

A customer does not have to own the copyright to alert us to a concern. However, a person claiming to act for a copyright owner should explain that authority.

Reports must be accurate to the best of the sender's knowledge and must not include knowingly false allegations, fabricated evidence, or misleading claims of ownership.

5. How to Submit a Complaint

Email support@techmentorurdu.com with the subject “Copyright Complaint — [Product Name or ID]”.

To help us locate the material and assess the concern, provide:

  1. Your name and a contact email;
  2. Whether you are the rights owner, an authorised representative, or another person reporting a concern;
  3. A description of the original work and the rights you believe are affected;
  4. The marketplace product name, product ID, or direct listing link;
  5. A clear explanation of the alleged infringement, identifying the material concerned;
  6. Available supporting evidence, such as original source material, publication records, relevant agreements, or comparison screenshots; and
  7. A statement that the information is accurate to the best of your knowledge and, where you claim to represent the owner, an explanation of your authority.

Copyright may arise without formal registration. The absence of a registration certificate alone is not a reason to reject a complaint or ownership claim.

Do not send passwords, full payment-card details, or unrelated identity documents. Redact irrelevant confidential information where possible. If a specific legal notice procedure applies, further information may be needed under that procedure.

[Confirm any secure route for confidential evidence and additional legally required notice particulars. These suggested reporting details are not presented as a universal statutory notice form.]

6. Review-First Complaint Process

Our chosen approach is to review complaints and supporting evidence before making a final enforcement decision. A report is not automatically treated as proof of infringement.

The review may include:

  • Locating the relevant listing and reported material;
  • Checking whether the complaint identifies a credible ownership or infringement concern;
  • Requesting clarification or additional evidence;
  • Asking the vendor to respond and provide relevant ownership information; and
  • Comparing the available information and determining an appropriate marketplace response.

Where necessary, a product may be temporarily hidden or access restricted while the concern is assessed. Temporary action is not a final finding that the vendor has infringed copyright.

The review-first approach does not override a binding legal order or an applicable duty to act promptly. Urgent protective action may be necessary in particular circumstances.

[Confirm acknowledgment and review timeframes, the decision-maker, urgent-action criteria, and how parties are informed.]

7. Vendor Responses and Ownership Evidence

A vendor asked to respond should explain the basis of its ownership claim and provide relevant evidence. Depending on the product, useful evidence may include development records, dated source files, authorship records, ownership agreements, or other material supporting the claimed rights.

A licence for an incorporated component should be distinguished from ownership of the whole product and from authority to sell another person's product.

Vendor response period: [Insert the confirmed deadline and any procedure for extensions.]

If the vendor does not provide sufficient evidence, the ownership concern may remain unresolved and the product may require continued restriction or other action following review. Failure to provide evidence does not, by itself, conclusively prove infringement. It also does not show that the complaint was false.

Sensitive evidence should be handled proportionately. The process should not require unnecessary public disclosure of proprietary source code or identity documents.

8. Outcomes and Action Against Vendors

Where review substantiates a copyright violation, action will be taken against the responsible vendor. Vendors who breach marketplace terms or repeatedly defraud customers are subject to account suspension and withheld payouts under the applicable vendor arrangements.

[Confirm the enforcement options and criteria, including removal of infringing listings, treatment of repeat violations, suspension, and any account termination process.]

A payout hold does not authorise unlimited permanent confiscation of all vendor earnings. Any withholding, recovery, deduction, or release must have a lawful basis and follow the applicable agreement and proportionate review procedures.

Where the evidence is inconclusive, the outcome should distinguish an unresolved concern from a substantiated violation. A marketplace review is not a court judgment about copyright ownership.

9. Deliberately False or Abusive Reports

We will take appropriate action against a customer or other account holder where review establishes deliberate false reporting, fabricated evidence, or misuse of the complaint process.

A complaint that cannot be substantiated is not automatically dishonest. A good-faith mistake, genuine uncertainty, or a disputed legal interpretation must not be treated as deliberate fraud merely because no action is taken against the vendor.

[Confirm the available sanctions, the evidence required, the opportunity to respond, and any review process. No automatic monetary penalty or payout confiscation for complainants has been agreed.]

This section must not discourage legitimate reports or restrict legally protected complaint rights.

10. Disputed Decisions and Restoration

If you disagree with a marketplace decision, contact support@techmentorurdu.com, identify the relevant complaint or product, explain the disagreement, and provide any additional evidence.

[Confirm the review deadline, reviewer, restoration criteria, and timing for restoring a wrongly restricted listing. Do not promise automatic restoration after a fixed period that has not been agreed.]

Restoration must take account of the evidence, any applicable legal requirements, and other unresolved concerns. A vendor's response alone does not automatically resolve a dispute.

Submitting a complaint or response through this policy does not remove a party's right to seek independent legal advice or use an applicable legal remedy.

11. Customer Purchases Affected by a Complaint

If a purchased product is affected by a substantiated ownership concern or restriction, customers can contact support@techmentorurdu.com for assistance.

Tech Mentor Urdu LTD will intervene where a vendor fails to address an unresolved purchased-product concern. Any remedy must reflect the facts, the purchase agreement, the completed Refund Policy, and applicable mandatory rights.

This is not a promise of an automatic refund for every reported product. Approved refunds are returned to the original payment method.

[Confirm what happens to existing licences, downloads, updates, and customer notices when a listing is restricted or removed.]

12. Information Used During Review

Complaint information and vendor responses may need to be used to assess the issue and communicate with relevant parties. The completed Privacy Policy should explain applicable processing purposes, lawful bases, recipients, and retention.

[Confirm which complaint details are shared with vendors or complainants, any redaction process, retention periods, and handling of confidential material. Do not promise complete anonymity or unrestricted disclosure.]

13. Applicable Legal Processes

This is a marketplace reporting policy. It is not a substitute for a court process and does not automatically establish a US Digital Millennium Copyright Act notice-and-counter-notice system or statutory safe-harbour eligibility.

[Obtain legal advice on any jurisdiction-specific procedures needed for a global marketplace, including any designated-agent requirements, notice particulars, or statutory response rules.]

Applicable law and binding legal requirements take priority over inconsistent operational wording in this policy.

14. Updates and Contact

Changes to this policy should be accompanied by an updated effective date and any notice required by law or the applicable agreement. Changes must not retrospectively remove mandatory rights.
